Border Capital Bank Trust On-Line User Agreement

Border Capital Bank-Trust Division, McAllen, Texas (“Trust”), is offering to provide its clients with access to their trust account information via the Web.  Trust clients will access this online service through a link provided on our Border Capital Bank - Trust Division homepage:  www.bordercapitalbank.com.

This Border Capital Bank-Trust Division Terms and Conditions of Use Agreement (“Agreement”) shall govern your use of the Trust On-Line service.  By your application for and use of this online service, you agree to the terms and conditions contained in this Agreement. 

System and Equipment Requirements: 
Your use is subject to the technological requirements of the Trust On-Line service.

Security Features:
We will establish a User ID of your choosing (minimum of 4 characters and a maximum of 10 characters) and assign you a temporary password for access to Trust On-Line.  After your initial log-in to our online service, you will be prompted to complete the enrollment process by entering your assigned password, selecting a Confidence Image, entering an identifying Welcome Message for that image (maximum of 22 characters), and then selecting three security questions.  You will then register your computer as a Private Computer.  Once you have registered your computer, you will be prompted to change your assigned initial password to one of your choice. NOTE:  Passwords are case sensitive; see Password Requirements below.  Once the enrollment process has been completed, you will thereafter only be required to enter your User ID and Password at future logins.  After you enter the User ID, you will see the picture which you had previously selected along with the word or message assigned to that image; this will assure you that you are connected to the official website.  If you attempt to access the website from an unregistered computer, you will be asked to answer one of the security questions you selected when you implemented dual factor authentication. 

Password Requirements
Security of your account data is important to us.  Use of the website requires a User ID and Password.  Each individual who has access to the website must have a User ID and a temporary password which we will assign. 
Your password must be a minimum of 6 characters, up to a maximum of 10 characters, which must consist of at least 1 upper case letter, 1 numeric character, and 1 of the following special characters:
~ ! @ # $ ^  & * ( ) _ + - = { } | [ ] \ : ; < > ? , . /  
Your password will be permanent, although we strongly recommend that you change your password periodically to enhance security.  This may be done by going into the Preferences folder in the Trust On-Line site, and there entering a new password for your next login to the site.  At present, a new password cannot be the same as the previous 5 passwords.  We reserve the right to modify the password change cycle and the established limits on the re-use of passwords.
To guard against unauthorized use of your User ID and Password, your password will be disabled after three attempts to log-in.  The disabling of the password keeps an unauthorized agent from attempting to guess a password.  This will occur if you accidentally activate this security feature by unintentionally miss-keying a password three times.  You will need to wait 31 minutes before attempting to log back in to the Trust On-Line site.  If you are unable or unwilling to wait those 31 minutes, you may call your account administrator at Border Capital Bank to advise of the lockout and request the reassignment of a password for your access to account(s). If our support group needs to assign a new password for your User ID, you will be forced to go through the enrollment process again. 
The Trust On-Line site has a timeout of 10 minutes.  So, if after logging onto the Trust On-Line site you are not actively using the features of the site or if you leave your computer unattended, you will be automatically logged out after the timeout period.
If you lose or forget your User ID or Password, please call your account administrator during normal bank business hours as listed on the homepage. 
You agree to keep your User ID and Password secret to you and your authorized agents and to notify us immediately (in person or by live telephone conversation with an Account Administrator) if your User ID or Password is lost or stolen or if you believe someone else has discovered your User ID or Password.  You are liable for all transactions conducted and information disclosed through the use of your User ID and Password until such time as you have notified us, and we have had time to remove such User ID and Password authority from the Trust On-Line system.  You agree that if you give your password to someone else, you are authorizing them to access and view your trust account information.  Do not discuss, compare, or share information about your account number(s), User ID, or Password with anyone else unless you are willing to give them full access to your trust account information.  WE WILL NOT ACCEPT NOTIFICATION OF LOST OR STOLEN ACCESS IDs OR PASSWORDs VIA E-MAIL OR FAX. 

Equipment:
You are solely responsible for the equipment (including your personal computer and software) you use to access the Trust website.  We are not responsible for errors or delays or your inability to access the website if caused by your or our equipment or service failures.  We are not responsible for the cost of upgrading equipment to stay current with the service and we are not responsible for any damage to your equipment or any data residing on your computer due to use of our trust online services or equipment, whether caused by the fault of trust or others.

Business Days/Hours of Accessibility:
You can usually access your accounts through the website seven (7) days a week, 24 hours a day.  However, at certain times, some or all of the website may not be available due to system maintenance or reasons beyond the Trust Division’s control.  The Trust Division specifically does not warrant that the Trust On-Line will be available at all times.

 Waiver of Liability:
you waive any liability, obligation, or responsibility of trust for any loss, injury, damage to property, or injury or damage of any kind to you or the customer, or to any data of you or the customer, caused by access to (or lack of ability to access) or use of the trust online service, even if such damage or injury is due to the fault or negligence of trust, service failures, or other persons or causes.  such waiver includes any liability of trust for the security of information transmitted to or from the trust online website and servers to other computers accessing the website through your user id and password.

 Termination of Service or Electronic Statement Delivery:
If you wish to revoke your consent to receive your trust accounts statements via the Internet or if you want to terminate you access to the Trust On-Line service, you may do so at any time by sending notice in writing to the attention of your account administrator. 
We reserve the right to temporarily suspend the Trust On-Line service in situations deemed appropriate by us, in our sole and absolute discretion, including when we believe a breach of the system security has occurred or is being attempted.  We may consider repeated incorrect attempts to enter your User ID or Password as an indication of an attempted security breach. 

Amendments:
We can change a term or condition of this Agreement by mailing or delivering to you a written notice at least thirty (30) days before the effective date of any such change.  We do not need to provide you with any prior notice when an immediate change in the terms or conditions of this Agreement is necessary to maintain and restore the security of our system or an account.  However, even in these cases, if the change is to be made permanent, we will provide you with a notice of the change with the next regularly scheduled periodic statement that we send you, or within thirty (30) days, whichever is later, unless disclosure would jeopardize the security of our system or an account.  Notices mailed or delivered to you under this paragraph will be considered effective and received by you if mailed to the most recent address we show on our records for you or current e-mail address to which you authorized the Trust Division to send such notices and/or disclosures.

Cautions:
By accessing the Trust On-Line service, you hereby acknowledge that you will be entering a protected web site which may be used only for authorized purposes.  Any unauthorized use may be a violation of state and/or federal law and will be prosecuted to the fullest extent allowed by law.  Trust reserves the right to, but is not obligated to, monitor, audit, and/or record any and all communications and activity related to the Trust On-Line service.  Use of the Trust On-Line system may be subject to the federal Computer Fraud and Abuse Act.
